General Terms & Conditions of Contract

NUCLIO DIGITAL SCHOOL SL (hereinafter referred to as “NUCLIODS”) undertakes, within five (5) days from the date of Enrolment Fee payment receipt and thus, registration of the USER (hereinafter referred to as “STUDENT”) in the program, to render the STUDENT the means to complete the courses subject to contracting.

NUCLIODS will deliver to the STUDENT all the didactic material of the contracted program, on the first day of the theoretical course commencement at the latest.

The STUDENT is obliged to pay the full amount of the program. Failure to attend class will not entitle the right to request a refund. The STUDENT authorizes the processing of personal data provided, including photographs (if any), in accordance with the Privacy Policy published on the website https://nuclio.school/politica-privacidad/

The STUDENT declares that they are aware of and expressly accepts these General Terms and Conditions, which are necessary and obligatory to access the services and/or programs offered by NUCLIODS.

1. Payment of Registration and Program Fees

All NUCLIODS programs require a Registration Fee to be paid upon enrolment, and a payment of the remaining program fee (hereinafter referred to as the “Price”). The total amount of the Registration Fee and the Price will be referred to as the Total Price. These amounts will be communicated by the Admissions Department to the STUDENT, and may be paid in accordance with the provisions of these General Terms and Conditions.

1.1 Registration Fee:

Corresponds to the amount to be paid in advance at the time of contracting to ensure the reservation of the chosen program. The reservation of the place in the chosen program will be informed to the STUDENT by the Admissions Department and is non-refundable; subject to the exceptions listed in the General Conditions of Contract.

1.2 Price:

In the case where the Price has not been paid as an upfront payment, this value corresponds to the outstanding value resulting from the difference between the amount of the Total Price and the Registration Fee. The resulting amount can be paid in accordance with Installments Payment stipulated these terms and conditions:

1.2.a Methods of Price Payment:

The STUDENT may choose to pay the Price via one of the following options:

  • Upfront Payment: The STUDENT elects to pay the Total Price at the time of enrolment, combining Registration Fee and the Price together, which comes with an additional discount on the Total Price
  • Deferred Payment: The STUDENT will have a period of 15 calendar days from the date of the Registration Fee payment to pay the pending amount of the Price. If the payment of the Price exceeds 15 calendar days, the STUDENT will no longer be entitled to any possible discounts that may have been granted for having chosen this payment method.
  • Installments Payment: The STUDENT elects to pay the Registration Fee at the time of enrolment, and then commence paying monthly installments summing to the Price. Installments may be selected through:
    • External Financing: One of NUCLIODS Financial Partners can support the STUDENT with extended monthly installments, after the STUDENT paid the Registration fee to NUCLIODS detailed in these conditions.
    • NUCLIODS Financing: After paying the Registration Fee as detailed in these conditions, the STUDENT can elect completing the remaining payment of the Price by means of financing through NUCLIODS, demonstrating creditworthiness and subject to the conditions to be agreed upon between the STUDENT and NUCLIODS.

1.2.b Payment by installments through NUCLIODS:

By choosing this form of payment, the STUDENT agrees to pay the Price as Monthly Fees as per the number of installments agreed on during registration, starting from the month following the Registration Fee payment date, NOT from the start date of the program. The installments can be completed by bank transfer, payment link, direct debit or any other means authorized by NUCLIODS to collect the fees.

The Monthly Fees agreed with NUCLIODS cannot exceed the duration of the digital program by more than ONE month

In case of a delay in payment or non-payment of Monthly Fees by the STUDENT, they will be considered in overdue status and will be contacted by the NUCLIODS Finance Department. Until the outstanding amount is settled as soon as possible, NUCLIODS Finance Department will restrict the STUDENT access to NUCLIODS virtual campus until the situation is regularized.

Failure to meet the agreed upon deadlines for program fees payment by the STUDENT, for more than 60 days, will result in the cancellation of the program registration and the loss of the amounts paid without the right to receive any refund or to take any other program.

NUCLIODS reserves the right to withhold any documentation, certificates, logins, credentials and/or diplomas related to the STUDENT enrolment or progress in the program if there are any unpaid pending fees

2. Cancellation Refund Request / Right of Withdrawal:

In relation to the reimbursement of the payment made directly by the STUDENT to NUCLIODS as a Registration Fee, the STUDENT is eligible to request a refund within a period of up to fourteen (14) calendar days after the date of payment. The STUDENT has the right to receive a refund of the amount paid within 30 calendar days from the refund request date approval. If the program has already started, academic management expenses and days of classes taken/attended will be deducted from the refunded amount.

Likewise, the STUDENT who paid the full cost of the program in cash directly to NUCLIODS, will have the right to withdraw from the program and request a refund within fourteen (14) calendar days after the date of payment, and will have the right to receive a refund of the amount paid within 30 days. Similarly, if the program has already begun, academic management fees and class days taken will be deducted.

Once the withdrawal period of 14 calendar days has elapsed, the STUDENT shall not be entitled to any refund from NUCLIODS.

In relation to the reimbursement or cancellation of other amounts accrued through the subscription of a loan contract with collaborating financial entities, such as NEMURU, Banco Sabadell, LAUDEX, Quotanda, among others, the STUDENT shall be subject to the conditions agreed between the STUDENT and said financial entity. NUCLIODS is not responsible in any case for the refund to the STUDENT of the amounts that have been agreed between the STUDENT and the financial institution. Thus, the term of withdrawal period established herein shall not apply to those amounts not received directly by NUCLIODS from the STUDENT.

In relation to the refund of payment made directly to NUCLIODS for the Price, whenever this amount has been paid in cash or in installments, it will only be refunded outside the withdrawal period. for the reasons of force majeure described below. In this case and depending on the reasons of withdrawal, the STUDENT is required to provide associated documentation(s) justifying such reasons, and considering the following deadlines and refund percentages:

Such reimbursements will be made within 30 calendar days from the accreditation of the reasons for the reimbursement.

To make the request for refund of the above clauses, the STUDENT must inform NUCLIODS by explicit request by e-mail to the Academic Department, with the minimum information necessary for NUCLIODS to refund the amount paid so far: full name, tax identification number (NIF, CIF, NIE, ID…), proof of payment of the amount(s) and the account number of the recipient bank (where the refund is to be received).

When the cancellation of the service is made by NUCLIODS, the STUDENT shall be entitled to receive a 100% refund of the amount paid, or to select any other available program start date, if the STUDENT has not cancelled or partially consumed the course beforehand, in which case the STUDENT will have the right to reschedule the program by selecting another date, but not to receive any refund.

Under no circumstances may the STUDENT assign their program, payment, or any service contracted by the STUDENT to a third party.

If NUCLIODS is unable to deliver the program sessions in person for reasons of force majeure, including any measure derived from the authorities due to the Covid-19 health crisis, the program will continue its course in online format with the same content and number of hours as in the classroom mode.

3. Change of Edition Conditions:

A “Change of Edition” means the act of postponing your studies until the next available convocation of the program in which The STUDENT is enrolled and shall only be eligible for an edition change subject to the following conditions:

  • The STUDENT may request a Change of Edition before the start date of the program at an additional cost of 5% of the Total Price of the program at the time of the change request.
  • The STUDENT may request a Change of Edition after the start date of the program and during the first 14 days at a cost of 20% of the Total Price of the program at the time of the change request

After the start date of the program and after 14 days have elapsed, THE STUDENT shall not be entitled to a Change of Edition.

If the STUDENT who requests a Change of Edition and has chosen to pay for their program via the installment payment modality, the STUDENT will be obliged to continue to comply with the payments stipulated in the terms agreed upon in the initially enrolled master’s program.

No change can be requested if the STUDENT has any outstanding amount due with NUCLIODS or its financial partners.

4. Delivery of Title Award:

In programs where the STUDENT has chosen the installment payment method, the delivery of the title awarded by NUCLIODS will be subject to compliance by the STUDENT of the agreed installments and can only be delivered when the master’s degree has been paid in full.

 

IN WITNESS WHEREOF, NUCLIODS and the STUDENT agree to and abide by the outlined clauses of this General Terms & Conditions of Contract upon the STUDENT registration and official enrollment.
