The following terms and conditions (hereinafter “Terms”) govern all uses of the website nuclio.school.com, mobile application, mailbox, and the offer of products and services. The Services are provided by NUCLIO DIGITAL SCHOOL, S.L. with a registered office at Mèxic, 17, 08004 Barcelona, registered in the Commercial Register of Barcelona in volume 46615, folio 185, page B-52555 and provided with CIF number B-67.304.717 (“NUCLIODS“).

NUCLIODS’ services are mainly aimed at offering technological bootcamps (“BOOTCAMPS”) and related activities.

In any case, access to the website nuclio.school.com by any Internet user implies acceptance and compliance with these Conditions, so that, before access and/or use of such content, the USER must carefully read the Conditions.

For the contracting of any BOOTCAMP or services/products offered, NUCLIODS will previously provide the specific conditions of the same as specific conditions that must be expressly accepted by the USER and become an integral part of these Conditions.

Terms of Use

Registration

The USER shall access the NUCLIODS website or mobile application (collectively the “Platform”) and register by entering the information required by NUCLIODS at that time. In particular, the USER shall provide the following personal data:

  • Name and surname
  • E-mail
  • Telephone
  • City
  • Country

Any USER may inform NUCLIODS of any abuse or violation of these Terms and Conditions by sending an e-mail to [email protected] or unsubscribing from the Platform by sending an e-mail to [email protected].

USERS shall refrain from using their profile and other content of the Platform for illegal purposes or effects that are harmful to the rights and interests of others, or in any way damage, disable, affect or impair the Platform, its contents, and its Services, exempting NUCLIODS from any liability, damage or harm that may arise from such access or illegal use by third parties.

General Contracting Conditions:

NUCLIODS undertakes, from the date of registration of the USER (hereinafter the “STUDENT”), to make available to the student the means for the completion of the courses under contract. 

NUCLIODS will deliver to the STUDENT, at the time of registration, or on the first day of the theoretical course, all the teaching material for the contracted course.   

The STUDENT undertakes to pay the full amount of the course. Failure to attend class will not entitle the STUDENT to any refund. The STUDENT authorises the processing of the personal data provided, including photograph(s) (if any), and the Data Protection Policy set out in these Conditions shall apply. 

Payment in instalments:

  • The first payment for the course and/or may never be less than 10% of the total value of the course. 
  • The amount equivalent to 10% of the value of the course will constitute a deposit for reservation of place, and therefore not recoverable except in cases of force majeure, or unless less than 15 days have elapsed since registration, and any service or well-associated with the course has not been attended or partially consumed.
  • In courses that are paid in instalments, failure to meet the agreed deadlines for full payment of the course in more than 30 days, will result in the cancellation of the course and the loss of the amounts paid, without the right to receive any refund or to take any other course.
  • The instalments will be paid between the 1st and 5th of each month by debit/credit card. The student must make the first payment using the link sent by the school. In this way, he/she will accept that the following monthly instalments, will be automatically charged to the indicated card. 

Refund for cancellation: 

  • The STUDENT may cancel the programme within a period of up to fourteen calendar days after the first payment made, and will be entitled to receive a full refund of the amount paid to date within 30 days.
  • Once the withdrawal period has elapsed, the STUDENT shall not be entitled to any refund from NUCLIODS.
  • To request a refund of the above clauses, the STUDENT must inform NUCLIODS by express request by email to the admissions advisor with the minimum information necessary for NUCLIODS can make the refund of the amount paid so far: full name, tax identification number (NIF, CIF, NIE, ID…), proof of payment of registration to the training action and the account number of the bank where you want to receive the refund.
  • When the service is cancelled by NUCLIODS, the STUDENT will have the right to receive a 100% refund of the amount paid, or to select any other available date, provided that the STUDENT has not cancelled or partially consumed another course previously, in which case he/she will have the right to reschedule it by selecting another date, but not to receive any refund.
  • Under no circumstances may the STUDENT transfer their course, their payment or, in short, any service contracted by and/or for them to a third party.

Conditions of change of edition:

  • The STUDENT shall only be eligible for a change of edition under the following conditions:
  • The STUDENT may request such a change of edition before the start of the programme for 10% of the price (RRP) of the programme at the time of requesting the change.
  • The STUDENT may request such a change of edition after the start date of the programme and during the first 15 days for 20% of the price (RRP) of the programme at the time of requesting the change.
  • After the start date of the programme and after 15 days have elapsed, the STUDENT is not entitled to change the edition. 
  • The STUDENT will be obliged to comply with the payments stipulated in the Enrolment Form within the deadlines agreed in the Master’s programme currently enrolled.
  • No change can be requested if the STUDENT has any outstanding amount to be paid to NUCLIODS.

Intellectual and industrial property rights

NUCLIODS is the owner or licensee of all intellectual and industrial property rights included in the Platform as well as the content accessible through it. The intellectual property rights of the Platform, as well as: texts, images, photographs, graphic design, navigation structure, information and content contained therein are owned by NUCLIODS, who has the exclusive rights to exploit them in any form and, in particular, the rights of reproduction, distribution, public communication and transformation, following Spanish legislation on intellectual and industrial property rights. Authorisation to the USER for access to the Platform does not imply any waiver, transmission, licence or total or partial transfer of intellectual or industrial property rights by NUCLIODS.

It is not permitted to delete, circumvent or manipulate in any way the contents of the NUCLIODS Platform.

It is also forbidden to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, process or distribute in any way all or part of the contents included in the Platform for public or commercial purposes, without the express written permission of NUCLIODS or, where appropriate, the holder of the corresponding rights.

The USER who proceeds to share any type of content through the Platform ensures that he/she has the necessary rights to do so, exempting NUCLIODS from any liability for the content and legality of the information offered. The provision of content by USERS through the Platform will involve the transfer to NUCLIODS, free of charge, and the fullest extent permitted by law, the rights of exploitation of intellectual or industrial property derived from such content.

The USER undertakes to use the contents in a diligent, correct and lawful manner and, in particular, undertakes to refrain from deleting, evading or manipulating the copyright and other data identifying the rights of NUCLIODS or its owners included in the contents, as well as technical protection devices or any information mechanisms that may be included in the contents. Likewise, the user shall refrain from using the contents and, in particular, information of any kind obtained through the Platform to send advertising, communications for commercial purposes, unsolicited messages addressed to a plurality of people regardless of their purpose, as well as to refrain from marketing or disclosing in any way such information.

NUCLIODS informs that it does not grant any implicit licence or authorisation whatsoever on the intellectual and/or industrial property rights or any other right or property related, directly or indirectly, to the contents included in the Platform.

Right of Withdrawal

Following the provisions of law, the USER has a maximum period of 14 calendar days from the formalisation of the contract with NUCLIODS to withdraw from it. If the BOOTCAMP has begun before the end of the period of 14 calendar days, there will be no right of withdrawal. NUCLIODS will state this right of withdrawal in the initial information provided to the USER to enter into the contract, in a clear, understandable and unequivocal manner.

To exercise the right of withdrawal, the user will have to notify their decision to withdraw from the contracted service through an unequivocal statement addressed to NUCLIODS (for example, a letter sent by post, fax or email).

Protection of personal data

NUCLIODS is fully committed to regulatory compliance, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR) and the regulations related to the protection of personal data in force at any given time, in compliance with which we inform you that your data will be incorporated and processed in the files of NUCLIODS, to be able to provide and offer our services. The user may exercise the rights of access, rectification, cancellation and opposition by writing to the address: Plaza Pau Vila 1, Esc. A-2ª, 08039, Barcelona.

As long as the USER does not inform NUCLIODS to the contrary, NUCLIODS will understand that his/her data have not been modified, that the USER undertakes to notify NUCLIODS of any variation and that NUCLIODS has the consent to use them to be able to maintain the loyalty of the relationship between the parties.

Modification of the Terms of Use

NUCLIODS reserves the right to modify, at any time, the presentation and configuration of the Platform, as well as these Conditions. Therefore, NUCLIODS recommends the USER to read them carefully each time he/she accesses the same. USERS will always have the Conditions in a visible place, freely accessible for any queries they wish to make. If any clause of these Conditions is declared invalid, the other clauses shall remain in force and shall be interpreted taking into account the will of the parties and the purpose of these Conditions.

NUCLIODS does not guarantee the absence of interruptions or errors in accessing the Platform or its content, nor that it is always updated, however, NUCLIODS will carry out, provided that there are no causes that make it impossible or difficult to execute, and as soon as it becomes aware of the errors, disconnections or lack of updating in the content, all efforts to correct the errors, restore communication and update the content.

In the event of the impossibility of teaching the Nuclio Digital School S.L. master’s degree sessions in person, as a consequence of force majeure, including any measure derived from the authorities due to the Covid-19 health crisis, the programme will continue its course in streaming format with the same content and number of hours as in the face-to-face mode.

Consequently, the participants of each master’s course are aware of and accept this circumstance and waive any claim against Nuclio Digital School for this modification.

Applicable law and jurisdiction

The relationship between NUCLIODS and the USER shall be governed by current Spanish legislation and any dispute shall be submitted to the Courts and Tribunals of Barcelona.

NUCLIODS will pursue the breach of these Conditions as well as any improper use of the Platform, exercising all civil and criminal actions that may correspond to it and that may be applicable by law.
